Tax ID (NIP): 6312683118, KRS: 0000761507, REGON: 382007090.
- Contact: sklep@poznajraypath.pl, telephone +48 727 932 629. Correspondence concerning contracts or complaints may also be sent to the registered address of the Seller.
- Address for returning goods following withdrawal from the contract: Nowe Lokum Sp. z o.o., ul. Nowowiejska 6/35, 00-649 Warszawa, Poland.
- These terms and conditions apply to purchases of physical products offered in the Shop. Raypath products are manufactured by Raypath International; the Customer enters into the sales contract in this Shop with the Seller identified above.
§ 2. Definitions
- Customer means a natural person, a legal person or another entity with legal capacity that uses the Shop. Consumer means a natural person entering into a legal transaction that is not directly related to their business or professional activity.
- A sole trader with consumer rights means a natural person entering into a contract directly related to their business activity where that contract is not professional in nature for that person, as indicated in particular by the scope of their business disclosed in CEIDG. The statutory rights granted to that person apply to the extent provided for by law.
- Goods or Product means a movable item offered in the Shop. Order means a declaration submitted by the Customer through the order form with the intention of entering into a sales contract. Account means an optional Customer profile, where this feature is available in the Shop.
- Business day means Monday to Friday, excluding public holidays in Poland. Statutory withdrawal and complaint periods expressed in days refer to calendar days.
§ 3. Using the shop and electronic services
- Using the Shop requires an internet-connected device and an up-to-date browser. Placing an order or sending a message through the form requires a working email address. The selected payment method may require an appropriate payment instrument or application.
- Browsing the range, using the contact form and using the basket are free of charge. The order form service runs from the moment the Customer starts completing it until the order is placed or the Customer stops using the form. The Customer may stop before placing an order.
- The Customer must provide accurate information needed to fulfil the order. Unlawful content must not be submitted and the operation of the Shop must not be disrupted.
- Problems concerning electronic services may be reported to sklep@poznajraypath.pl with a description of the problem and contact details for a reply. The Seller responds to a Consumer complaint concerning an electronic service within 14 days of receiving it.
§ 4. Customer account
- The Shop offers Customer accounts. An Account can be created in the “My account” section or during checkout by providing an email address (and a password, or using a password sent to that address). Creating an Account is voluntary and free of charge. An Account provides access to order history, saved shipping details and easier future purchases. Data provided when creating an Account is processed in accordance with the Privacy Policy. An Account is not required to make purchases. Available Account features are displayed in the customer panel.
- The agreement for maintaining an Account is entered into for an indefinite period. The Customer may terminate it at any time by writing to sklep@poznajraypath.pl. Termination does not affect rights relating to previous purchases.
- The Customer should protect their login details. Deleting an Account does not delete data that must or may continue to be retained under the law or for establishing, pursuing or defending claims.
§ 5. Products, prices and promotions
- Product descriptions, photographs and prices constitute an invitation to enter into a contract, unless expressly stated otherwise. The product page sets out the product’s essential characteristics, variant and instructions or warnings appropriate to the type of goods.
- Prices are stated in Polish zloty (PLN) and include applicable taxes, including VAT. Delivery charges are stated separately. Before placing an order, the Customer receives a summary of the total price of the products and delivery.
- When a price reduction is announced, the Shop states the lowest price charged during the 30 days before the reduction. For a product offered for less than 30 days, it states the lowest price charged since the product was first offered, in accordance with applicable law.
- The terms of a specific promotion or discount code, including its scope and period of validity, are provided before the promotion is used. The final price and the value of the products after discounts are shown before the order is placed.
- Food supplements offered in the Shop are food products, not medicinal products, and are not intended to treat or prevent diseases. They must not be used as a substitute for a varied diet. They are not intended for children or pregnant or breastfeeding women. Do not exceed the recommended daily serving. Directions, dosage, ingredients, allergens and warnings are provided on the product page and packaging. People taking medication or with chronic medical conditions should consult a doctor before using a supplement. By ordering a food supplement, the Customer confirms that they have read this information.
§ 6. Orders and formation of the contract
- The Customer selects products, adds them to the basket, provides the information required to fulfil the order and selects an available delivery and payment method. Before placing the order, the Customer may correct their details, change the basket contents and check the total amount.
- An order is placed after reading these terms and conditions and ticking the acceptance box, by using the “Order with obligation to pay” button or equivalent unambiguous wording. Consent to marketing or optional cookies is not a condition of purchase.
- The Seller sends an acknowledgement of receipt of the order to the email address provided. The sales contract is formed when the Seller sends the Customer confirmation that the order has been accepted for fulfilment. An acknowledgement of receipt alone, without such acceptance, does not constitute formation of the contract.
- Confirmation of the concluded contract, the applicable terms and conditions, and withdrawal information together with the withdrawal form are sent to the Customer by email on a durable medium.
- If an order is not accepted, the Seller informs the Customer and promptly refunds any payment received, without additional charges. The Seller does not replace an ordered product with another product without agreement with the Customer.
§ 7. Payments
- The Shop accepts electronic payments only, processed by Stripe and Przelewy24 depending on the selected payment method. Stripe services in Europe are provided by Stripe Payments Europe Limited (Ireland); information about the services and data processing is available at stripe.com/legal and stripe.com/privacy. Przelewy24 is operated by PayPro S.A., based in Poznań, ul. Pastelowa 8, 60-198 Poznań, KRS 0000347935. Payments are subject to the Przelewy24 payment terms available at przelewy24.pl/regulations. Methods available for a particular order are shown at checkout. Payment is made before order fulfilment.
- The Shop does not accept cash on delivery or cash payments. Full payment card details are transmitted to the payment provider; they must not be sent by email or through the contact form.
- If a payment requires additional confirmation by the bank or payment provider, the Customer completes it in accordance with the information displayed during payment. A failed or interrupted payment does not confirm that the order has been paid for.
- The Seller issues a sales document in accordance with applicable law. A Customer requiring an invoice should provide the correct buyer details before placing the order.
- Card payments are processed by Stripe or Przelewy24, depending on the payment method selected at checkout. For card payments made through Przelewy24, the operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000347935, NIP 7792369887, REGON 301345068.
§ 8. Delivery and order fulfilment
- The Shop offers delivery by DPD courier within Poland. Delivery costs PLN 20 including VAT for a product value below PLN 400 and PLN 10 including VAT for a product value of PLN 400 or more. The threshold is calculated on the product value after discounts, excluding the delivery charge.
- The Seller arranges fulfilment of the order and remains the contracting party and the entity responsible to the Customer for the sale, delivery, returns and complaints. Data needed to prepare and deliver the parcel directly to the Customer is shared with Raypath and the carrier, in accordance with the Privacy Policy.
- Preparation and dispatch within 24 hours after payment is received (business days only). Estimated DPD delivery: a further 1–2 business days.
- The Seller promptly informs the Customer of any obstacle to fulfilment. A change to the delivery time requires agreement and does not restrict the Customer’s statutory rights.
- The risk of loss of or damage to the goods passes to the Consumer when the Consumer, or a person designated by them other than the carrier, receives the goods. Where the Consumer independently selects a carrier not offered by the Seller, the relevant legal provisions apply.
- If a parcel is visibly damaged, it is advisable to take photographs and complete a damage report. The absence of a report is not grounds for refusing statutory complaint rights.
§ 9. Withdrawal from the contract and returns
- A Consumer and a sole trader with consumer rights may withdraw from a distance contract within 14 days without giving a reason, subject to statutory exceptions. The Shop does not apply a blanket exclusion of the right of withdrawal to all cosmetics, supplements or cleaning products. The exception for goods supplied in sealed packaging applies only where, after opening, the goods cannot be returned for health protection or hygiene reasons and the statutory conditions are met. The product category name alone does not determine whether this exception applies.
- The period starts when the Customer, or a person designated by them other than the carrier, receives the goods. For several goods delivered separately, in batches or in parts, it starts upon receipt of the last item, batch or part.
- To meet the deadline, send an unambiguous withdrawal statement to sklep@poznajraypath.pl or to the registered address of the Seller before the deadline expires. You may use the form at the end of these terms, but this is optional. The Seller confirms receipt of an electronically submitted statement on a durable medium.
- The goods must be sent back no later than 14 days after the withdrawal statement is submitted, to: Nowe Lokum Sp. z o.o., ul. Nowowiejska 6/35, 00-649 Warszawa, Poland. The Customer bears the direct cost of returning the goods.
- The Seller refunds the payments received, including the cost of the least expensive standard delivery offered for the order, no later than 14 days after receiving the withdrawal statement. The refund may be withheld until the goods or proof of their return are received, whichever occurs first.
- The refund is made using the same payment method, unless the Customer expressly agrees to another method that is free of charge. The Customer is responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Opening the packaging or the absence of the original packaging does not, in itself, constitute general grounds for refusing withdrawal.
§ 10. Product complaints
- The Seller is responsible for the conformity of the goods with the contract. In relation to a Consumer and a sole trader with consumer rights, liability for a lack of conformity existing at delivery and becoming apparent within 2 years is governed by the Polish Consumer Rights Act, subject to the exceptions provided for by law.
- Complaints may be sent to sklep@poznajraypath.pl or to the registered address of the Seller. Describe the product, the lack of conformity and the remedy requested, and provide contact details. An order number and photos help with handling the complaint; the form and receipt are not the only accepted ways to submit a complaint or demonstrate a purchase.
- The Customer may request repair or replacement. The Seller may change the selected remedy or refuse to bring the goods into conformity only in the cases provided for by law, in particular where this is impossible or would involve excessive costs.
- A price reduction or withdrawal from the contract due to a lack of conformity is available under statutory conditions, in particular where repair or replacement has not been carried out properly, has been refused, or the lack of conformity is significant. Withdrawal on this ground is not available for a minor lack of conformity.
- The Seller bears the costs of bringing the goods into conformity, including the relevant transport costs. The Seller responds to a Consumer’s complaint within 14 days of receipt; failure to respond means that the complaint is accepted. The response is provided on paper or another durable medium.
- Any manufacturer’s guarantee does not limit rights against the Seller. Complaints from businesses without consumer rights are handled in accordance with the relevant provisions of the Polish Civil Code.
§ 11. Personal data and cookies
- The Seller is the controller of data processed by the Shop. The purposes, legal bases, data recipients, retention periods and individual rights are described in a separate Privacy Policy.
- Information about cookies and tools that use the user’s device is provided in the Cookie Policy. Consent to optional tools is managed in the cookie settings. Refusing optional analytics or marketing consent does not prevent purchases.
- Enquiries concerning personal data may be sent to sklep@poznajraypath.pl. Reading the Privacy Policy does not in itself constitute consent to marketing or recording user behaviour.
§ 12. Dispute resolution and final provisions
- A Consumer may obtain free assistance from a municipal or district consumer ombudsman and use available out-of-court complaint resolution procedures. UOKiK provides information and a register of the relevant bodies at polubowne.uokik.gov.pl.
- After the complaint procedure ends, if the dispute has not been resolved, the Seller provides the Consumer on a durable medium with the legally required information on its agreement or refusal to participate in out-of-court proceedings and on the relevant body. These terms and conditions do not constitute a declaration of mandatory participation in every procedure.
- Contracts are governed by Polish law. This choice does not deprive a Consumer of protection under mandatory provisions of the law of the country of their habitual residence. No provision restricts the Customer’s statutory rights.
- The contract may be concluded in Polish or English, according to the selected Shop language. The terms and conditions in force when the order is placed apply to that order. Later changes do not apply retrospectively.
- Changes to these terms and conditions may result from changes in the law, the Seller’s details, or available services, payments or deliveries. For an existing Account service, the Seller informs the Customer of the change and its reasons at least 14 days before it takes effect, allowing the Account to be cancelled free of charge.
